Do You Need a Permit for a Porta Potty in Georgia? What Atlanta Homeowners & Event Planners Need to Know

One of the most common questions we get from first-time renters — and even experienced ones — is: do I need a permit to have a porta potty delivered?
The short answer: usually not for private property. But the full answer depends on where the unit is going, what it's for, and who governs that property. Here's the breakdown.
Private Property: Generally No Permit Required
For the vast majority of porta potty placements in Georgia — residential job sites, construction projects on private land, backyard events, private commercial properties — no permit is required.
You own (or are working on) the property, you're using a licensed waste hauler (that's us), and the placement is temporary. In most Metro Atlanta jurisdictions, this falls well within normal property use.
This includes:
Home construction, additions, and remodels
Commercial construction on private land
Backyard parties, weddings, and family events on private property
Business events on private commercial property
Renovation projects at rental properties
Permitted Public Events: Permit May Be Required
If your event requires a special event permit from a city or county — festivals, road races, community markets, outdoor concerts on public property — the permitting process often includes a check on sanitation facilities.
In practice, this usually means:
The city or county may require documentation that you have adequate restroom facilities for your expected attendance
ADA-compliant units are typically required for any permitted public event
You may need to include restroom unit counts in your permit application
We can provide documentation of our services, unit counts, and ADA compliance if your permit requires it. Just ask.
OSHA Requirements for Construction Sites
For construction sites, it's not a permit question — it's a compliance requirement. OSHA standard 29 CFR 1926.51 mandates toilet facilities for workers:
1 toilet per 10 workers for an 8-hour shift
Facilities must be maintained in sanitary condition
Adequate handwashing facilities must also be available
Non-compliance can result in OSHA citations and fines. Our construction site rental packages include scheduled servicing to keep you compliant throughout the project.
HOA and Neighborhood Considerations
Some HOA communities have rules about the placement of construction equipment or temporary facilities. If you're doing a renovation in an HOA community, it's worth checking your association's guidelines for temporary facility placement — specifically whether there are rules about where porta potties can be positioned relative to the street or neighboring properties.
Placement Considerations to Keep in Mind
Even without a permit, there are practical placement considerations:
Setback from property lines — We recommend keeping units away from neighboring property lines as a courtesy
Access for service vehicles — We need to be able to reach the unit for delivery, servicing, and pickup
Level surface — Units should be placed on relatively flat ground for safety and proper function
Visibility and aesthetics — For residential events, positioning units discreetly keeps them out of event photos
