The OSHA Standard


OSHA standard 29 CFR 1926.51 covers sanitation requirements for construction sites. The key provisions:


Toilet facilities are required. Employers must provide toilet facilities for all construction workers. Employees cannot be required to use facilities that are inconveniently located or inaccessible.


Minimum unit ratios:

20 or fewer workers: At least 1 toilet facility required

20+ workers: 1 toilet seat and 1 urinal per 40 workers

200+ workers: 1 toilet seat and 1 urinal per 50 workers


The most common rule of thumb used in the industry — and the one OSHA inspectors typically reference for smaller sites — is 1 toilet per 10 workers on an 8-hour shift.


Sanitary condition required. It's not enough to have a unit on site — it needs to be maintained in a sanitary condition. Regular servicing is an implicit requirement.


Handwashing facilities. OSHA 29 CFR 1926.51(f) requires adequate handwashing facilities. For most construction sites, this means hand washing stations with soap and water (not just hand sanitizer).


Common Violations and Fines


OSHA construction site sanitation violations are more common than most contractors realize, particularly during peak construction seasons. Common violations include:


Insufficient number of units for the worker count on site

Units not maintained in sanitary condition — dirty, non-functional, or out of supplies
